1. Agreement to Terms

By accessing or using PriceCheck Jamaica ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and PriceCheck Jamaica, governed by the laws of Jamaica.

2. Description of Service

PriceCheck Jamaica is a crowdsourced price comparison platform that allows users to:

• Submit and view prices for products across Jamaica
• Compare prices between different stores and locations
• Create and manage shopping lists
• Scan receipts and price tags using AI-powered technology
• Receive price alerts and notifications
• Earn rewards for contributing accurate price information

3. User Accounts

Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

Account Restrictions

• You must be at least 13 years old to create an account
• You may only create one account per person
• Accounts are non-transferable

5. User-Submitted Content

Your Content

You retain ownership of content you submit (prices, photos, reviews). However, by submitting content, you grant us:

• A worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content
• The right to modify or adapt your content for the Service
• The right to sublicense these rights to other users of the Service

Content Standards

All submitted content must:

• Be accurate and truthful to the best of your knowledge
• Not infringe on any third party's rights
• Not contain offensive, harmful, or illegal material
• Not contain personal information of third parties

Content Moderation

We reserve the right to review, edit, or remove any content that violates these Terms or that we deem inappropriate. We may use automated systems and community reporting to identify problematic content.

The Service and its original content (excluding user-submitted content), features, and functionality are and will remain the exclusive property of PriceCheck Jamaica. This includes:

• The PriceCheck Jamaica name, logo, and branding
• Website design and user interface
• Software, algorithms, and AI models
• Aggregated and analyzed price data
• Documentation and marketing materials

8. Rewards Program

Our rewards program is subject to the following conditions:

• Points are earned for verified, accurate price submissions
• Points have no cash value and cannot be transferred
• We reserve the right to modify or discontinue the rewards program
• Fraudulent activity will result in forfeiture of all points and account termination
• Rewards redemption is subject to availability and additional terms

The Service may contain links to third-party websites or services. We are not responsible for:

• The content or accuracy of third-party sites
• The privacy practices of third-party services
• Any transactions with third parties
• Any loss or damage arising from use of third-party services

10. Disclaimers

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY JAMAICAN LAW, PRICECHECK JAMAICA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claims arising from use of the Service shall not exceed the amount you paid us, if any, during the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless PriceCheck Jamaica and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third party's rights
• Content you submit to the Service

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Conduct harmful to other users or the Service
• Any reason at our sole discretion

You may terminate your account at any time through the account settings or by contacting us. Upon termination, your right to use the Service will cease immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Jamaica.

15. Dispute Resolution

Before filing a formal legal claim, you agree to try to resolve the dispute informally by contacting us. We will attempt to resolve the dispute through negotiation within 30 days.

If informal resolution fails, any legal action must be filed in Kingston, Jamaica, and you consent to personal jurisdiction in Jamaica for such proceedings.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PriceCheck Jamaica regarding the Service and supersede any prior agreements.
